PRIVACY POLICY
Bay Title Company (BTC) values your business and is committed to protecting the privacy of your nonpublic personal information (NPI). NPI includes your first name or first initial and last name coupled with any of the following: Social Security Number, Driver 's License Number, State-issued ID Number, Credit Card Number, Debit Card Number, or other Financial Account Numbers.
Purpose.
BTC is a Maryland corporation and a wholly owned subsidiary of Council, Baradel, Kosmerl & Nolan, P.A. Its purpose is to assist you in the completion of your residential real estate settlement in accordance with the written instructions from your lender during which deeds, mortgages and other required instruments are executed and delivered, an accounting between the parties is made, funds are disbursed and appropriate documents are recorded.
Information Collected.
In the normal course of business and to provide the necessary services to you, BTC may obtain your NPI directly from (i) you; (ii) your mortgage broker or agent, lender, or real estate agent; or
(iii) other parties claiming an encumbrance or an interest in title whose claim or interest must be determined, settled, paid or released prior to the completion of your residential real estate settlement.
Access to Information.
Access to your NPI is limited to BTC associates who need to have your NPI in order to perform the necessary services to you. BTC associates include, but are not limited to, licensed title producers who are all attorneys, and BTC settlement processors .
Information Sharing.
BTC does not disclose your NPI that it obtains with anyone for any purpose that is not specifically permitted by law. BTC may disclose your NPI (i) when necessary to complete your residential real estate settlement; (ii) when required to do so by applicable law or legal process; or (iii) to law enforcement authorities or other governmental officials.
Information Security.
BTC maintains physical, electronic, and procedural safeguards that comply with federal regulations to protect your NPI. Notwithstanding the foregoing, you acknowledge that perfect security does not exist, therefore, BTC makes no representations or warranties with regard to the sufficiency of these security measures .
Updates to Policy.
BTC may amend this Privacy Policy from time to time without notice to you.
